Terms and Conditions of Sale — Sandbox ShoppyCrush
Version: cgv-2026-05-01-v1 — Last updated: May 1, 2026
Preamble
These Terms and Conditions of Sale (« T&Cs ») exclusively govern the contractual relationship between Sandbox ShoppyCrush, operated by [Legal name not provided] (« the Seller »), and any person making a purchase on the shop (« the Buyer » or « the Customer »).
The T&Cs are distinct from the Terms of Use (ToU) of the ShoppyCrush Platform, accessible from the footer, which govern the relationship between the Buyer and the Platform. The Seller is the sole party to sales contracts concluded on their shop; QIANOV intervenes solely as a technical intermediary.
Acceptance of these T&Cs at the time of placing an order, materialised by a contextualised checkbox, is a mandatory prerequisite for the conclusion of the sales contract. This acceptance is subject to an immutable snapshot archived by the Platform and accessible from the Buyer's personal account.

2. Scope and acceptance
2.1 Scope
These T&Cs apply to all sales of products or services concluded between the Seller and the Buyer via the Sandbox ShoppyCrush online shop, to the exclusion of any other general conditions and notwithstanding any contrary provisions that may appear on the Buyer's commercial documents.
The T&Cs apply to sales concluded with consumers within the meaning of the French Consumer Code. For B2B sales (between professionals), the specific B2B terms and conditions prevail; failing which, these T&Cs apply as they stand.
2.2 Acceptance
The Buyer acknowledges having read these T&Cs at the time of placing the order, and accepts them expressly and without reservation by ticking the dedicated checkbox labelled « I accept the Sandbox ShoppyCrush T&Cs and the ShoppyCrush ToU ».
The Seller reserves the right to modify the T&Cs at any time. The applicable conditions are those in force at the time the order is placed, archived in the form of an immutable snapshot.
3. Products and services offered
The products and services offered for sale are those appearing on the shop at the time of browsing, within the limits of available stock. The Seller endeavours to present the products offered as faithfully as possible, but cannot be held liable for any material errors or omissions in the descriptions (the Buyer in any event has the remedies provided for in articles 9 (withdrawal) and 10 (warranties)).
Photographs illustrating the products are not contractual insofar as they do not pertain to essential characteristics; however, any information relating to an essential characteristic (material, dimensions, composition, format, etc.) appearing in the description is contractual.
4. Price
4.1 Price display
Product prices are displayed in euros (€), inclusive of all taxes (VAT included), including VAT applicable at the rate in force at the time of the order, excluding delivery charges which are indicated separately at the cart checkout step.
4.2 Seller's VAT regime
The Seller is subject to the VAT exemption (Article 293 B of the French General Tax Code) tax regime.
If the Seller falls under the VAT exemption scheme (Articles 293 B et seq. of the French General Tax Code), the notice "VAT not applicable, Article 293 B CGI" appears on invoices, and no VAT is charged to the Buyer. If the Seller is subject to VAT, the applicable VAT is shown separately on invoices.
4.3 Prices guaranteed at the time of order
The price paid by the Buyer is that displayed and confirmed at the time of order validation. Any subsequent change in prices has no effect on orders currently being processed. Delivery charges are also guaranteed at the amount indicated at cart checkout.
5. Order
5.1 Order process
The Buyer selects products, adds the desired options, provides their delivery address, accepts the T&Cs (contextualised checkbox), confirms their order, and proceeds to payment.
Before final validation, the Buyer has the opportunity to review the order details, the total amount, and to correct any errors (article 1127-2 of the French Civil Code).
5.2 Order confirmation
After payment validation, the Seller sends the Buyer, to the provided email address, a confirmation email summarising the order details, order number, total amount paid, delivery address, and return address. This email contains, as an attachment or via a secure link, the corresponding invoice.
5.3 Right to decline
The Seller reserves the right to refuse or cancel an order in the following circumstances: non-payment, suspected fraud, manifest error in the displayed price, Buyer's non-compliance with the T&Cs, prolonged product unavailability, manifestly excessive or abusive request. In the event of refusal, the Buyer is informed without delay and fully refunded where applicable.
6. Payment
6.1 Payment methods
Payment is made exclusively by bank card via the payment service provider Stripe, in a secure environment compliant with PCI-DSS standards. The Buyer's banking details are entered directly with Stripe; neither the Seller nor QIANOV have access to them at any time.
6.2 Marketplace architecture (Destination Charges)
The Buyer pays the total amount to the Seller. Payment technically transits through the ShoppyCrush Platform's Stripe Connect account, which automatically deducts the commission agreed with the Seller (see the commission article in the Seller Charter), then transfers the net balance to the Seller's account. QIANOV does not at any time acquire ownership of the funds destined for the Seller, other than its commission.
Payment processing fees are applied to each transaction, calculated according to the schedule in force displayed on the platform. They are separate from the ShoppyCrush commission.
6.3 Validation and conclusion
The order is definitively formed on the date on which Stripe confirms payment authorisation and the Platform generates confirmation. In the absence of payment validation, the order is cancelled and the Buyer is informed.
6.4 Late or failed payment
Any late or failed payment (bank rejection, unjustified opposition) automatically suspends order processing. The Seller may terminate the contract without formality and the Buyer remains liable for the amounts due.
7. Delivery
The terms of delivery (zones, timeframes, carrier, rates, tracking, force majeure) are set out in the Shipping Policy, accessible from the shop footer. This policy forms an integral part of the T&Cs for orders containing physical products.
As a reminder: in accordance with article L216-1 of the French Consumer Code, the Seller undertakes to deliver within a maximum period of thirty (30) days from the date of contract conclusion. Failing this, the Buyer may exercise the remedies provided for in article L216-2 (contract termination, full refund).
8. Digital products
8.1 Making available
Digital products (PDF file downloads, multimedia content) are made available to the Buyer immediately after payment confirmation, via a secure download link sent by email and also accessible from the Buyer's personal account (under "My Downloads").
8.2 Link security
Download links are signed, time-limited, and linked to the Buyer's identity. They cannot be shared; any attempt to share or resell them results in link revocation and may give rise to an action for copyright infringement.
8.3 Exception to the right of withdrawal for digital content
In accordance with article L221-28, 13° of the French Consumer Code, the right of withdrawal cannot be exercised in respect of digital content provided on an intangible medium (download) whose execution has begun after the consumer's express agreement and express waiver of their right of withdrawal at the time of order. This notice is clearly presented to the Buyer when purchasing digital products.
8.4 Link regeneration and reporting
In the event of a technical problem with an expired link or a dispute concerning a digital product, the Buyer may request link regeneration or submit a report from their personal account. The Seller processes the request as promptly as possible.
9. Right of withdrawal
9.1 Period and terms
In accordance with article L221-18 of the French Consumer Code, the consumer Buyer has 14 days to exercise their right of withdrawal, without having to give reasons for their decision.
The terms of exercise, the return procedure, and the refund are detailed in the Refund Policy accessible from the shop footer. This policy forms an integral part of the T&Cs.
9.2 Exceptions to the right of withdrawal (article L221-28)
The right of withdrawal cannot be exercised in the cases provided for in article L221-28, and in particular for goods made to specification, digital content downloaded with express agreement and waiver of the right of withdrawal (see article 8.3), unsealed goods that cannot be returned for hygiene reasons, etc.
9.3 Return address
All returns must be sent to the following address:
[Return address not configured]
Return to any other address is not valid.
9.4 Refund
The Seller proceeds with the refund within the statutory period of fourteen (14) days from the date on which the Seller is informed of the withdrawal decision (article L221-24 of the French Consumer Code — a statutory deadline independent of the Buyer's withdrawal period referred to in article 9.1). The refund is made using the original payment method.
10. Statutory warranties
This section reproduces in full the mandatory statutory warranties applicable by law. It cannot be modified or diminished by the Seller.
10.1 Statutory warranty of conformity (articles L217-3 et seq. of the French Consumer Code)
The Seller delivers goods conforming to the contract and is liable for any defects of conformity existing at the time of delivery.
The action arising from a defect of conformity is time-barred after two years from delivery of the goods (article L217-7). During the twenty-four months following delivery (twelve months for second-hand goods), defects of conformity that appear are presumed to have existed at the time of delivery, unless proven otherwise.
The Buyer may choose between repair and replacement of the goods, subject to the cost conditions provided for by law (article L217-9). If repair and replacement are impossible or impose a manifestly disproportionate cost, the Buyer may obtain a price reduction or contract termination (article L217-13).
The Buyer is not required to prove the existence of a conformity defect in the goods during the twenty-four months (twelve months for second-hand goods).
10.2 Warranty against hidden defects (articles 1641 et seq. of the French Civil Code)
The Buyer may choose to rely on the warranty against hidden defects in the goods under the conditions of articles 1641 et seq. of the French Civil Code. In this case, the Buyer may choose between cancellation of the sale or a reduction in the sale price in accordance with article 1644 of the French Civil Code.
The action arising from latent defects must be brought by the Buyer within two years of the discovery of the defect (article 1648 of the French Civil Code).
10.3 After-sales service
The Buyer may address any request relating to the exercise of statutory warranties to the Seller, via the contact details in the Legal Notice. The Seller processes the request within a reasonable time.
10.4 Commercial warranties
The Seller may, in addition to the statutory warranties, offer a commercial warranty. Where applicable, its terms are indicated on the product page or in a separate contractual document. The commercial warranty does not substitute for and does not limit the mandatory statutory warranties referred to in articles 10.1 and 10.2.
11. Liability
11.1 Best-efforts obligation
The Seller undertakes, as a best-efforts obligation, to carry out its services in accordance with the rules of the trade and professional practice. The Seller cannot be held liable for:
- Non-performance attributable to a force majeure event within the meaning of article 1218 of the French Civil Code;
- Non-performance attributable to the carrier, unless a direct failure by the Seller in selection or instructions can be demonstrated;
- Non-performance attributable to the Buyer (incorrect address, refusal of delivery, repeated absence).
11.2 Limitation for indirect losses
Without prejudice to mandatory consumer protection rules, and in particular the provisions of articles 10.1 and 10.2, the Seller cannot be held liable for indirect losses (loss of profit, data loss not caused by the Seller, reputational harm, etc.).
11.3 Scope of liability
The Seller is solely responsible for product quality and conformity, compliance with deadlines, and the fulfilment of its contractual obligations. QIANOV, as technical intermediary of the Platform, is not a seller and cannot incur liability in that capacity.
12. Personal data
The processing of personal data in the context of these T&Cs falls under joint controllership between the Seller and QIANOV pursuant to article 26 of the GDPR. The arrangements are detailed in the Privacy Policy, accessible from the footer.
The Buyer may exercise their rights of access, rectification, erasure, objection, restriction, and portability with the single point of contact: dpo@qianov.fr. The Privacy Policy sets out the modalities for exercising these rights.
13. Intellectual property
The shop's content (texts, photos, logo, descriptions, digital files) is protected by intellectual property law and belongs to the Seller or third parties who have granted the Seller a licence. Any unauthorised reproduction or use is prohibited and constitutes infringement (articles L335-2 et seq. of the French Intellectual Property Code).
The purchase of a digital product grants the Buyer a personal right of use, non-exclusive, non-transferable, and limited to private use consistent with the nature of the product. No right of reproduction, public performance, modification or resale is granted.
14. Disputes and mediation
14.1 Prior complaint
In the event of a difficulty or dispute, the Buyer is invited to submit a prior written complaint directly to the Seller via the contact details in the Legal Notice.
14.2 Consumer mediation
In the absence of an amicable resolution within a reasonable period, the consumer Buyer may contact the consumer mediator designated by the Seller free of charge, pursuant to articles L611-1 et seq. of the French Consumer Code:
- Mediator: [Mediator not configured]
- Website: [Mediator URL not provided]
- Postal address: [Mediator address not provided]
The Buyer may also use the European online dispute resolution (ODR) platform accessible at https://ec.europa.eu/consumers/odr.
14.3 Competent jurisdiction
In the absence of an amicable agreement and successful mediation, disputes shall be submitted to the competent French courts, without prejudice to mandatory consumer protection rules (articles 17-18 of the Brussels I bis Regulation).
14.4 Applicable law
These T&Cs are governed by French law.
15. Final provisions
15.1 Immutable contractual snapshot
The Buyer's acceptance of the T&Cs at the time of order is subject to an immutable snapshot archived by the ShoppyCrush Platform. This snapshot constitutes the contractually binding version in respect of the relevant order, irrespective of any subsequent changes to the T&Cs.
15.2 Severability
If any provision of these T&Cs were found invalid or unenforceable, the remaining provisions would remain in full force and effect.
15.3 T&Cs amendments
The T&Cs may be amended to reflect legislative, regulatory, or commercial changes. The version applicable to a given order is that in force at the time of its validation, archived as an immutable snapshot.
15.4 Notices
Any notice validly given under these T&Cs may be sent by email to the respective addresses of the Parties.
